Top state income tax rates in 2028
Question: Where would Washington's 9.9% rank among top statutory state income tax rates in 2028?
Result: Washington's 9.9% would tie Oregon for the fifth-highest top state income tax rate, behind California (13.3%), Hawaii, New York (10.9%) and New Jersey (10.75%). The District of Columbia (10.75%) is also higher but is not a state.
Operation: Sort the 2028 top rates of the states; rank ties equally.
Scope: 50 states (DC listed but not ranked as a state)
View this analysis
- Statutory top rates only; ignores where the top rate starts, local income taxes and payroll taxes.
Effective state income tax rates for married couples, wages only
Question: What share of income would a married couple with $1.5 million, $2 million or $5 million of wages pay in state income tax in Washington (2028 law), Oregon, California and Massachusetts?
Result: Washington's effective rate is the lowest of the four at each level: 3.3% at $1.5 million, 4.95% at $2 million and 7.92% at $5 million, against 9.6-9.8% in Oregon, 10.0-12.3% in California and 6.0-8.1% in Massachusetts.
Operation: Apply each state's 2026 brackets and standard deduction or exemption; Washington = 9.9% of income above $1,000,000.
Scope: Married filing jointly, wages only
View this analysis
- Wages only; ignores capital gains, which Washington taxes separately, and credits for taxes paid to other states.
- Oregon and California exemption credits, which phase out at these incomes, are ignored.
Components of the 18.037% Seattle combined top rate on wages
Question: What does the Tax Foundation's 18.037% figure for Seattle include?
Result: 9.9% income tax + 0.58% WA Cares + 5% Seattle Social Housing Tax + 2.557% JumpStart = 18.037%. Only 9.9 points are income tax; 7.557 points are employer-paid payroll taxes, and no federal tax is included.
Operation: Sum the four components the Tax Foundation lists.
Scope: Wages above $1 million earned in Seattle, from 2028
View this analysis

Limitations and reproducibility
Reproducible: build_rates.js contains every input rate and bracket and recomputes all tables; inputs are transcribed from the sources listed.
- Statutory top marginal rates only; local income taxes (such as New York City's and Portland-area taxes) and payroll taxes are excluded from the ranking.
- Hawaii's reported increase to 13% from 2027 comes from news reports and was not checked against the statute; Washington's rank is the same whether Hawaii's top rate is 11% or 13%.
- Effective rates assume a married couple filing jointly with wages only and the standard deduction or exemption; real returns have other income, deductions and credits. California's 1.3% SDI payroll tax on wages is not included.
- Some 2026 bracket thresholds in the Tax Foundation table use 2025 inflation widths.
- The Seattle combined rate counts employer-paid payroll taxes as if workers bore them, which is the Tax Foundation's method, not a statement of who legally pays.
